Order of Protection

Orders of Protection are available to an adult or minor victim who has been subjected to, threatened with, or placed in fear of domestic abuse, stalking, or sexual assault by a minor or adult who is (or was) of a certain relation to the victim, i.e., a spouse, live-in, dating or sexual partner, or related by blood, marriage, or adoption. If, however, an order of protection is based upon stalking, then there needn't be that certain relation between the victim and stalker, only than the victim has been stalked or is being stalked by the other.T.C.A. Section 39-17-315.

In certain circumstances, one other than the victim may apply for an order of protection to protect another. When applying for an order of protection, one need not reveal one's address in the paperwork to be given to the abuser. An order of protection may be sought where the victim resides, or where the abuse happened. If the abuser is not a Tennesseean, the victim may seek an order of protection in the county where the victim resides.

Although some disagreement exists about whether one who has an order of protection enter against him or her is able to possess a firearm, it appears the right to bear arms is lost once such an order enters. Once an order of protection enters, law enforcement officials are advised of the order of protection and will arrest one who is claimed to have violated the order of protection, even if the law enforcement officials did not witness the violation.
